Accessing, browsing, and using the website https://www.mecena.co/, as well as the Mecena application available on the App Store and the Play Store (hereafter referred to as the "Website"), implies the tacit and unreserved acceptance of all provisions of this legal notice, holding the same validity and efficacy as any written and signed contract.

Compliance with this notice is mandatory for any person who accesses, browses, or uses the Website. If you disagree with the terms set forth, please refrain from accessing, browsing, or using the platform.

Accessing and/or using the Website after the implementation of its modifications implies acceptance thereof.

However, access to certain content and the use of certain services may be subject to specific conditions, which will be clearly displayed and must be expressly accepted by the users. These specific conditions may replace, supplement, or, where appropriate, modify those set forth in this legal notice.

For the purposes of interpreting this legal notice, a person becomes a user (hereafter referred to as "User" or "Users") when they accept the legal notice and privacy policy outlined on the Website.

MECENA will not be held responsible for the accuracy of the data provided by Users. Each User is solely responsible for the potential consequences, errors, and failures that might arise from any inaccuracies in the data they provide.

5. Intellectual and Industrual Property Rights

5.1. Rights Regarding Content
MECENA holds, or where applicable, possesses the necessary licenses regarding the exploitation rights of intellectual and industrial property required to operate on the Website. This includes all content offered therein, such as the website itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content, as well as the services available through it.

5.2. Rights Regarding the Website
Under no circumstances should a user's access, browsing, and use of the Website be construed as a waiver, transmission, license, or total or partial transfer of these rights by MECENA. Users have a right to use the contents and/or services of the Website strictly for domestic purposes and solely to enjoy the service benefits in accordance with this legal notice.

References to registered trademarks or trade names, or other distinguishing signs, whether owned by MECENA or third parties, implicitly entail their prohibited use without the consent of MECENA or its rightful owners. Accessing, browsing, or using the Website and/or its contents at no point grants users any rights over the distinguishing signs included, unless otherwise specified in this legal notice.All intellectual and industrial property rights on the contents and/or services of the Website are reserved. Specifically, it's prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute, by any means and in any form, the entirety or part of the contents on the Website, unless with prior, express, written authorization from MECENA or, where applicable, the holder of the respective rights. Also, it's prohibited to delete or manipulate copyright indications or other credits identifying the rights holders of content found on the Website, as well as the technical protection devices, digital traces, or any protection or information mechanism incorporated into the content on the Website.

The services provided, or any information available through the Website, may not be used for commercial or advertising purposes without MECENA's prior authorization.

In all cases, users commit not to use the Website for illegal or prohibited purposes.

5.3. Rights Over Content and Information Shared by the User

Should a user send information or content of any kind to MECENA through any of the designated channels, the user states, guarantees, and accepts their right to do so freely. They ensure such information doesn't violate any intellectual property, industrial, trade secret rights, or any third-party rights, and that such information isn't confidential or harmful to third parties.

Users acknowledge their responsibility for any content they communicate, exempting MECENA from any responsibility.

If users become aware of any illicit content, illegal activities, or potential infringement of intellectual, industrial, or any other kind of rights, they must immediately notify MECENA at the given email address so that appropriate action can be taken.

Similarly, if any user or a third party believes any of the Website's content owned by MECENA violates their rights, they should communicate with social@mecena and provide:

- Identification data and contact method of the claimant or their legal representative;
- Documentation proving their status as the holder of the supposedly violated rights;
- Detailed account of the alleged infringed rights by MECENA and their exact location on the Website;
- Express declaration by the claimant that the content was used without the consent of the rights holder.

6. LINKS

6.1. Links to Other Websites
If the Website displays links to other sites via buttons, links, banners, or embedded content, MECENA informs that these are managed by third parties. MECENA doesn't have the human or technical resources to previously know, control, or approve all information, content, products, or services provided by other platforms linked from the Website.

As a result, MECENA cannot be held responsible for any aspect related to a website that may be linked from their Website.

If users become aware of any illegal activities conducted through these third-party websites, or if they contravene morality or public order, they should promptly notify MECENA so that the link can be disabled as soon as possible. In any case, establishing any link from the Website to an external website doesn't imply any relationship, collaboration, or dependency between MECENA and the owner of the external site.

6.2. Links to MECENA's Channels on Other Platforms and Social Networks

MECENA provides users with linking tools and applications that allow them to access MECENA's channels and website pages maintained on various third-party platforms and social networks (e.g., Twitter, LinkedIn, etc.). The inclusion of these links solely aims to facilitate users' access to these channels.

Establishing these applications doesn't imply any relationship between MECENA and the linked website's owner, manufacturer, or distributor. The sole responsibility for their content and services lies with the website's owner, manufacturer, or distributor.

Activating and using these applications might require user identification and authentication on the respective platforms, entirely external to MECENA's Website and control. Unauthorized access or use of the Website, whether for profit or not, is strictly prohibited. Users bear sole responsibility for any consequences of such actions. Specifically, users must not:

In accordance with the Organic Law 3/2018, all personal data collected during the Website's use will be processed as described in the Privacy Policy.

11. General Provisions

The headers of different sections are for informational purposes only and do not impact the interpretation of this legal notice. MECENA may amend these terms, with changes taking effect upon publication. MECENA may also terminate access to the Website's content without prior notice. In case any provision is declared null or inapplicable, it won't affect other provisions. Non-exercise of any rights by MECENA does not imply waiver of those rights.

12. Applicable Legislation and Jurisdiction

Current regulations will govern relationships between MECENA and Website users. For any disputes, Spanish legislation applies, and both parties submit to the jurisdiction of the courts of Madrid, Spain. Complaints can be directed to the email provided, with MECENA committed to an amicable resolution.
